TERMS & CONDITIONS OF THE SALE
- The employees of Violette Auction Company Inc intend to accurately describe each lot to the best of their ability; however neither Violette Auction Company Inc or our employees accept responsibility for any errors that may have occurred. To be certain of condition, please examine perspective items in person or by agent. The buyer, or their agent, shall be their own expert; or should consult an expert outside of Violette Auction Company Inc. ALL GOODS ARE SOLD AS IS, WHERE IS, WITHOUT RECOURSE TO SELLER. ALL SALES ARE FINAL.
- The auctioneer will acknowledge the high bidder of each lot and will be sole judge of the purchaser of each item. In the case of duplicate Absentee Bids, the one received first will prevail.
- The buyer assumes immediate and full responsibility for each item at the fall of the hammer or as he or she is recognized as the high bidder by the auctioneer.
- The record of the sale kept by Violette Auction Company Inc will be taken as final in the event of any dispute.
- As a convenience to our customers, Absentee Bids and Phone Bids will be executed by Violette Auction Company Inc in a competitive and confidential manner. All Absentee Bids and Phone Bids should be received 24 hours prior to the start of the auction and be accompanied by a 20 % deposit (unless other arrangements have been made). Violette Auction Company Inc will not be responsible for failure to execute Absentee or Phone bids.
- There will be a Buyers Premium of 15 % added to the hammer price of each lot, and will be considered part of the total purchase price. A discounted Buyers Premium of 10% will be charged to those who pay by means of cash or approved check .
- All purchases are subject to a 5 % Maine Sales Tax, unless the buyer has a valid resale certificate (which must be shown at time of Registration).
- All items purchased must be paid for in full on the date of the auction by an accepted credit card, cash or by approved check. Absentee and Phone bidders should make themselves available for notification the day following the sale and make payment no later than 3 days following the auction. In the event that an individual recognized as the high bidder fails to make full payment, or if a check is return for any reason, said buyer will incur all related costs of collection (including reasonable attorney’s fees) and be charged interest in the amount of 1 ½% monthly.
- The Auction Company reserves the right to hold property until checks clear. Buyers intending to purchase more expensive items should discuss payment with auction management prior to the auction.
- Arrangements for shipping or delivery should be made immediately following the auction. The buyer shall incur all related expenses.
- Violette Auction Company, Inc. reserves the right to withdraw any lot at any time prior to its sale.
- The auctioneer reserves the right to reject any opening bid that, in his opinion, does not commensurate with the value of the property offered.
- Employees of the Auction Company may bid on items on there own behalf.
- All property is sold AS IS, WHERE IS, WITHOUT RECOURSE TO THE SELLER, and neither Violette Auction Company Inc, its employees, nor the consignor makes any warranties, or representations of any kind or nature with respect to the property or its value, and in no event shall be responsible for the correctness of description, geniuses, attribution, provenance, authenticity, authorship, completeness, condition, or estimate of value. No statement, oral or written shall be deemed a warranty or representation or assumption of responsibility.
- The Uniform Commercial Code, Title 11, Sec2-328 applies to this sale.
